The terms of trade set out below govern all of the supplies of services from My Lotto Syndicate (“we”, “us”) to the Customer (“you”, “your”, “participant”, “member”). Your acceptance of any services from My Lotto Syndicate indicates your acceptance of these terms of trade. These terms of trade are effective from 1 December 2017.
Our terms of trade are as follows:
- We reserve the right to change service functions, content and presentation of the website at any time.
- We reserve the right to make changes to the Syndicate Agreement at any time and will advise all users when this happens. Anyone who disagrees with any changes will need to contact us stating their disagreement. Your agreement to the Syndicate Agreement will continue to be in force, including any changes, unless contact is made.
- We reserve the right to present users with advertising on any or all parts of the website.
- It is your responsibility to ensure that your member information is correct and for administrators to ensure that all information relating to the Syndicate is correct. My Lotto Syndicate will not be held responsible for any loss or consequence arising from incorrect information.
- We reserve the right to refuse any Syndicate and/or Member registration for any reason.
- We reserve the right to remove any Syndicate or Member where we receive a complaint about your membership or use of the website including (but not limited to), you do not provide the necessary information, you cannot be contacted, the content uses offensive language, is pornographic in nature, or where we consider the Syndicate or Member has breached our values or is acting in a manner that is detrimental to our reputation.
- We will not be held responsible for any actions or omissions of any Syndicate Administrator or Member.
- My Lotto Syndicate provides an online management service only and will not be held responsible for the carrying out of responsibilities of the Syndicate Administrator or Members, including the purchasing of tickets, uploading of ticket images, entering of amounts won, collection or distributions of funds or any other actions related to participating in a Lotto draw as a Syndicate.
- In no event will My Lotto Syndicate be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon any information contained on or omitted from the Site.
- All ticket images, profile images and syndicate images are copyrighted to you and will not be used for any other purpose other than for promotion on the My Lotto Syndicate website.
- By becoming a member on My Lotto Syndicate you allow us the right to email you with regular newsletters and updates.
- We will ensure the website is available at all times, however, we will not be held responsible for website downtime or error caused by the actions of any internet service provider or circumstances beyond our control.
- Trademarks on this site are owned by My Lotto Syndicate. You agree not to infringe any intellectual property rights owned by My Lotto Syndicate.
- You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from this website including code and software. You must not use this Site for any purpose that is unlawful or prohibited by these terms of use.
- You may not use data mining, robots, screen scraping, or similar automated data gathering, extraction or publication tools on this Site (including without limitation for the purposes of establishing, maintaining, advancing or reproducing information contained on our Site on your own website or in any other publication), except with our prior written consent.
- My Lotto Syndicate will not be held responsible for any addictive or inappropriate gambling behaviour of its members.
- My Lotto Syndicate provides no warranty to you that the services generally available through its site will be uninterrupted or error-free or that defects in the service will be corrected. You also understand that My Lotto Syndicate cannot and does not guarantee or warrant to you that any files available for downloading through the Site or delivered via electronic mail through the Site will be free of infection or viruses, worms, trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.
- You are responsible for your login and password. You are responsible for all/any activities made under your login name. You must notify My Lotto Syndicate of any breach of security.
- My Lotto Syndicate is is no way associated with The Lotteries Commission New Zealand or the Lotto trademark or game and as such does not adhere to any of the rules, regulations or requirements of the Commission in regards to the sale or use of its products or services. The use of the Lotto name is for identifying the lottery game for which the My Lotto Syndicate website can be used.
